What 49 CFR Part 391 Requires

A complete DQ file must include an employment application (FMCSA Form 391.21), a Motor Vehicle Record from every state where the driver held a license in the past three years, a certificate of driver's road test or its equivalent, annual MVR reviews, annual certifications of violations, the Medical Examiner's Certificate (MCSA-5876), and documentation of Clearinghouse queries and results. For drivers subject to CDL requirements, copies of the CDL must also be retained.

Retention Requirements

DQ files must be retained for the duration of employment plus three years for most documents. Annual MVR reviews and certifications of violations must be retained for three years. The employment application and road test certificate must be retained for the duration of employment plus three years. This means a carrier that has drivers for many years accumulates a significant document history that must be organized and accessible.
